Drug & Pharmaceutical Malpractice

Pharmaceutical liability cases and claims for dangerous and unsafe drugs and medical products result because a company marketed or sold an unsafe prescription drug, medical product or over the counter medication. Drug manufacturers, pharmacists, and doctors have a duty to ensure that the drugs and medical products they manufacture, prescribe and dispense for their patients and customers do not cause harm. Some drug and medical products have dangerous side effects, while others have the potential to cause long-term damage. These drugs and medical products are often the subjects of later recalls. While the Food and Drug Administration (FDA) plays a role in approving and monitoring the safety of a drug and a medical product, the manufacturers may remain ultimately responsible for injuries caused by their medications and medical products.

Users of certain medications and medical products may have a claim against the drug or product manufacturer, pharmacist, or the doctor who prescribed medication or used the product. For example, users of FOSAMAX (medication for osteoporosis may cause osteonecrosis of the jaw or spontaneous femur [leg] fractures), PAXIL (medication for depression and anxiety may cause babies to be born with birth defects or suicide in minors who use the drug), YAZ (oral contraception may cause blood clots, pulmonary embolism, deep vein thrombosis, heart attack, stroke), FIXODENT and POLIGRIP (over the counter products used to hold dentures in place may cause zinc poisoning, which has been associated with crippling neurological impairment), DEPUY ASR, ZIMMER and STRYKER hip replacements (have high failure rates which cause the need for additional surgery and artificial hip repair or replacement) and ZOCOR/SIMVASTATIN/VYTORIN (medications used for reduction of cholesterol can cause Rhabdomyolosis), may have possible claims against the drug manufacturer, pharmacist or doctor.
