Payment of medical bills after someone has been injured in an automobile accident can be quite complicated. In Pennsylvania, if you are injured in a car accident, either as a driver or passenger, as a pedestrian or on a bike, if you own a car with insurance or live in a household with a family member who owns a car with insurance, then your own car insurance or the car insurance of your family member living with you, must pay up to $5,000.00 in medical bills (unless there are higher medical benefits available on the policy) even though you were not at fault for causing the accident. This is commonly known as the "no fault rule" in Pennsylvania. It is important to note that payment of medical bills under a person's car insurance policy does not affect that person's premiums as long as that person was not at fault in causing the accident. People often don't understand why their own insurance company (or if they don't have car insurance why the insurance company of a family member living with them) has to pay for their medical bills if they did not cause the accident. Suffice it to say, that Pennsylvania requires this and a person injured in an auto accident doesn't get to choose who pays medical bills following a car accident.
